Conference of the Council of Europe on the role of constitutional court in safeguarding the supremacy of the Constitution

 

30 October 2015 - organised by the Council of Europe, Ministry of Foreign Affairs of Turkey, and European Union, a Conference of Central Asian constitutional control bodies took place on 28 and 29 October 2015 in Strasbourg on the role of constitutional court in safeguarding the supremacy of the Constitution. On that occasion, Professor Jasna Omejec, President of the Croatian Constituitonal Court, addressed Presidents and Judges of the Constititutional Courts and equivalent bodies of Kazakhstan, Kyrgyzstan, Tajikistan and Uzbekistan with the lecture on the role, place and meaning of the constitutional justice system in the light of the prinicple of the separation of powers. In her speech she emphasised that issues related to the separation of powers and constitutional justice are not only of a legal nature, but they are also political issues par excellence, but that the Constitutional Courts must always base their finding exclusively on the valid constitutional law, not in what might be politically, socially or economically appropriate. She also pointed out that regarding important constitutional issues such as the principle of the separation of powers, which have a prominent political dimension and which cause turbulence the Constitutional Court must not keep quiet but, even in the face of strong criticism, and huge negative reactions, and sometimes under unbearable pressure, it must stand firm, defend and shape fundamental constitutional principles of its country, always bearing in mind that the legal system is a living organism which breathes and grows and adjusts to serve the needs of society. In addition to the principle of the separation of powers, the participants also discussed about the constitutional interpretation techniques.
