Advocate General of the EU Court of Justice at the Constitutional Court

9 May 2024 - The Deputy President, Dr Snježana Bagić, today received Dr Tamara Ćapeta, Advocate General at the Court of Justice of the European Union, who came to Croatia together with her associates. During an informal meeting they talked about experiences in the application of EU law, focusing on the institute of preliminary rulings under Article 267 of the EU Treaty. When it comes to the jurisdiction of the Croatian Constitutional Court in relation to preliminary rulings, in addition to making the reference itself in a case concerning the application of the Regulation establishing the EU 'Erasmus+' program and obstacles to the free movement of students due to Croatian tax regulations, the Constitutional Court, in examining possible violations of the fundamental rights under the aspect of the "right to a court", requires that regular courts clarify their position on the necessity of applying EU law and of referring a request for a preliminary ruling to the Luxembourg Court.
